1. Agreement to Terms

By accessing or using VikVek Newsletter ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

VikVek Newsletter is an email marketing platform that allows you to:

• Create and manage email subscriber lists
• Send email campaigns to your subscribers
• Track campaign performance and analytics
• Manage multiple sender identities

3. Account Registration

• You must provide accurate and complete information when registering
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• You must be at least 18 years old to use the Service
• One account per user; multiple accounts are prohibited

4. Subscription Plans and Billing

4.1 Available Plans

• Free Tier: 100 subscribers, 2000 emails/month with daily limit of 100 emails, 30-day refill period
• Starter: €25/month or €240/year - 1,500 subscribers, 10,000 credits/month
• Professional: €60/month or €600/year - Unlimited subscribers, 30,000 credits/month, 5 sender identities, no branding

4.2 Billing and Payments

• All payments are processed securely through Stripe
• Prices are in Euros (€) and include applicable VAT where required
• Monthly subscriptions renew automatically on the same day each month
• Yearly subscriptions renew automatically every 12 months
• You authorize us to charge your payment method for recurring subscriptions

4.3 Free Trial and Free Tier

• New users receive 2,000 credits immediately upon email verification
• Free tier credits refill every 30 days (100 emails per day maximum)
• Free tier accounts include VikVek branding in emails

4.4 Credits and Usage

• Each email sent consumes one credit
• Subscription credits reset monthly on your billing date
• Unused subscription credits do not roll over to the next period
• One-time credit purchases never expire
• Credits are non-transferable and non-refundable

5. Cancellations and Refunds

5.1 Cancellation Policy

• You may cancel your subscription at any time by emailing support@vikvek.fi
• Cancellations take effect at the end of your current billing period
• You will retain access to paid features until the end of your billing period
• No partial refunds are provided for unused time in your billing period

5.2 Refund Policy

• Monthly Subscriptions: No refunds for any reason
• Yearly Subscriptions: Pro-rated refunds may be issued at our discretion for the first 14 days only
• One-time Credit Purchases: No refunds once credits are delivered to your account
• Policy Violations: No refunds if service is terminated due to violation of our Acceptable Use Policy

5.3 Termination Without Refund

Important: If we terminate your account due to violation of these Terms or our Acceptable Use Policy, you will immediately forfeit any remaining subscription period and credits without refund.

6. Service Availability and Support

6.1 Service Level

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance during low-traffic periods
• We will provide advance notice for planned maintenance when possible

6.2 Support

• Email support is provided at support@vikvek.fi
• We aim to respond within 48 business hours
• Priority support may be available for higher-tier plans

7. Data and Privacy

• We process personal data in accordance with GDPR and applicable privacy laws
• You are responsible for obtaining proper consent from your subscribers
• You must provide a privacy policy to your subscribers
• We will never sell your data to third parties

8. Intellectual Property

• You retain all rights to content you upload to the Service
• You grant us license to store and transmit your content as necessary to provide the Service
• VikVek and our logo are trademarks of VikVek TMI
• You may not use our trademarks without written permission

9. Limitations of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not responsible for deliverability issues caused by recipient email servers
• We are not liable for data loss; you should maintain backups of important content

10. Indemnification

You agree to indemnify and hold VikVek TMI harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of applicable laws or regulations
• Content you send through the Service

11. Changes to Service and Terms

• We may modify the Service at any time with or without notice
• We may change pricing for new subscriptions with 30 days notice
• Existing subscriptions maintain current pricing until renewal
• We may update these Terms at any time; continued use means acceptance
• Material changes will be communicated via email

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Finland.

12.2 Dispute Process

• Contact us first at support@vikvek.fi to resolve disputes informally
• Unresolved disputes will be handled in Finnish courts
• Both parties waive the right to jury trial

13. Miscellaneous

• Severability: If any provision is found invalid, the remaining provisions continue in effect
• No Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms; we may assign to an affiliate or successor
• Entire Agreement: These Terms constitute the entire agreement between you and VikVek
